1. Acceptance of Terms

By downloading, installing, or using the Cryptojis mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and LB2Holdings ("Company," "we," "us," or "our") governing your use of Cryptojis and all related services.

2. Description of Service

Cryptojis is a mobile application that provides:

• Emoji-based message encoding: Hide text messages within emoji characters using advanced encoding techniques
• Message decoding: Reveal hidden messages from encoded emojis
• Local storage: Save encoded messages on your device
• Premium features: Enhanced functionality through paid subscriptions
• Privacy-first design: All encoding/decoding happens on your device

3. Eligibility

To use Cryptojis, you must:

• Be at least 13 years old
• Be legally capable of entering into binding contracts
• Not be prohibited from using the App under applicable laws
• If under 18, have obtained parental or guardian consent

By using the App, you represent and warrant that you meet all eligibility requirements.

4. User Accounts and Registration

• No user account registration is required for basic features
• The App operates using device-local storage
• We do not collect personal identification information
• Premium features are tied to your Apple ID through App Store subscriptions
• You are responsible for maintaining the security of your device

5. Subscription Services

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• Subscriptions may be managed in your Apple ID Account Settings
• Auto-renewal may be turned off in Account Settings after purchase
• Any unused portion of a free trial period will be forfeited when purchasing a subscription

5.3 Free Trial Terms

• Free trials are available for select subscription plans
• You will not be charged during the free trial period
• If you cancel during the trial, you retain access until the trial ends
• If you don't cancel before the trial ends, you will be automatically charged
• Free trials are limited to one per Apple ID

5.4 Refund Policy

All sales are final. Refunds are handled exclusively by Apple according to their App Store refund policy. We do not process refunds directly. To request a refund, please contact Apple Support.

6. Acceptable Use Policy

6.1 Permitted Uses

You may use Cryptojis for any lawful purpose, including but not limited to:

• Personal privacy protection
• Confidential communications
• Creative messaging
• Educational purposes
• Business communications (with appropriate licenses)

6.2 Prohibited Uses

Violation of this policy may result in immediate termination of your access to the App and may be reported to law enforcement.

7. Intellectual Property Rights

7.1 Our Rights

• The App and its original content, features, and functionality are owned by LB2Holdings
• Protected by international copyright, trademark, patent, and trade secret laws
• Our trademarks and trade dress may not be used without written consent
• The encoding methods are protected by copyright

7.2 Your Rights

• You retain all ownership rights to content you create using the App
• You grant us a limited license to process your content solely to provide the service
• This license terminates when you delete the App

7.3 License Grant to You

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

Your privacy is fundamental to our service. Our data practices are governed by our Privacy Policy, which is incorporated by reference. Key points:

10.3 No Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• IN NO EVENT SHALL LB2HOLDINGS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• THIS INCLUDES BUT IS NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM
• THESE LIMITATIONS APPLY EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES

Some jurisdictions do not allow limitation of liability for certain damages, so the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless LB2Holdings, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you create, share, or transmit using the App
• Your violation of applicable laws or regulations

13. Termination

13.1 Termination by You

• You may stop using the App at any time by deleting it
• Subscription cancellations must be made through Apple App Store
• Deletion removes all local data from your device

13.2 Termination by Us

• We may terminate or suspend access for Terms violations
• Termination may occur without prior notice
• We reserve the right to refuse service to anyone

13.3 Effect of Termination

• Your right to use the App ceases immediately
• Paid subscriptions remain subject to Apple's refund policy
• Provisions that should survive termination will remain in effect
• We may delete any data associated with your device after 30 days

14. Dispute Resolution

14.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at support@cryptojis.com to seek informal resolution. We will attempt to resolve the issue within 30 days.

14.2 Arbitration Agreement

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the Consumer Arbitration Rules of the American Arbitration Association. The arbitration shall be conducted in California, United States.

14.3 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES ONLY ON AN INDIVIDUAL BASIS AND NOT AS PART OF A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You may not join or consolidate claims with other users.

14.4 Exceptions

This arbitration agreement does not apply to disputes concerning intellectual property rights or requests for injunctive relief.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. You consent to the exclusive jurisdiction of the courts located in California for any disputes not subject to arbitration.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Updating the "Effective Date" at the top
• Posting a notice in the App
• Sending in-app notifications for significant changes

Continued use after changes constitutes acceptance of the new Terms. If you disagree with changes, you must stop using the App.

17. Apple App Store Terms

If you downloaded the App from Apple App Store, the following additional terms apply:

• Apple is not a party to these Terms
• Apple has no obligation to provide maintenance or support
• Apple is not responsible for any product claims
• Apple is not responsible for addressing any third-party intellectual property claims
• Apple and its subsidiaries are third-party beneficiaries of these Terms

18. General Provisions

18.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and LB2Holdings regarding the App.

18.2 Severability

If any provision is found unenforceable, the remaining provisions will continue in full force.

18.3 Waiver

Our failure to enforce any right or provision is not a waiver of that right or provision.

18.4 Assignment

You may not assign these Terms. We may assign our rights without restriction.

18.5 Force Majeure

We are not liable for failures to perform due to causes beyond our reasonable control.

19. App Components

Certain components of Cryptojis may include third-party software. Such components are governed by their respective licenses.
